STUDIOS 17 SHORT-TERM RENTAL AGREEMENT

This Short-Term Rental Agreement (“Agreement”) is entered into between Studios 17 LLC (“Host”) and the individual making the reservation (“Guest”).

By completing a reservation, Guest acknowledges they have read, understood, and agree to be bound by this Agreement.

1. Reservation

The person making the reservation must be at least 21 years old and must occupy the property during the stay.

Guest accepts responsibility for all occupants, visitors, pets, and invitees.

Reservations obtained under false pretenses may be cancelled immediately without refund.

2. Check-In / Check-Out

Check-in: 3:00 PM

Check-out: 11:00 AM

Early check-in and late checkout may be available for an additional fee and only if approved in advance.

Failure to vacate by checkout time may result in additional charges.

3. Occupancy

Only registered guests listed on the reservation may occupy the property.

Undisclosed guests are subject to a $50 fee per person and may result in immediate cancellation of the reservation without refund.

No parties, events, gatherings, receptions, or unauthorized visitors.

4. Quiet Enjoyment

Quiet Hours:

10:00 PM to 8:00 AM

Guests agree to respect neighbors and other guests.

Excessive noise, disturbances, or police responses constitute a material breach of this Agreement.

5. Smoking Policy

Absolutely NO SMOKING OR VAPING inside the unit.

Smoking is permitted only in designated outdoor areas.

Do not smoke near doors or windows.

Evidence of smoke, vaping residue, odors, cigarette butts, or marijuana odors inside the property will result in:

• $300 Odor Remediation Fee

• Additional cleaning costs if necessary

• Possible immediate termination of stay without refund

6. Pet Policy

Pets are welcome only if disclosed during booking.

Undisclosed pets incur a $100 fee per pet.

Guests must:

• Keep pets leashed outdoors

• Pick up after pets

• Prevent excessive barking

• Keep pets off furniture and bedding unless protected

Guests are responsible for all pet-related damage.

7. Pool Rules

The pool is unsupervised.

Swim at your own risk.

No lifeguard is on duty.

Guests agree:

• No diving

• No running

• No glass containers

• Children under 16 require adult supervision

• No horseplay

• Keep gate closed

Host assumes no responsibility for accidents occurring in or around the pool.

8. Property Condition

Guest agrees to maintain the property in substantially the same condition received.

Guests shall immediately report:

Water leaks

Broken appliances

Damage

Safety concerns

Maintenance issues

Failure to report damage may result in additional charges.

9. Damages

Guest authorizes Host to charge the payment method on file for:

Property damage

Missing items

Excessive cleaning

Rule violations

Smoking fees

Pet fees

Unauthorized guest fees

Additional labor required to restore the property

Normal wear and tear excluded.

10. Security

Guest shall lock all doors and windows whenever leaving.

Host is not responsible for lost, stolen, or damaged personal belongings.

11. Parking

Only designated parking areas may be used.

No trailers, RVs, boats, or oversized commercial vehicles without prior approval.

Improperly parked vehicles may be towed at Guest’s expense.

12. Mechanical Failures

Host makes every effort to maintain all amenities.

No refunds shall be provided for temporary interruptions involving:

Internet

Cable

Utilities

HVAC

Pool

Appliances

Municipal services

provided Host acts reasonably to resolve the issue.

13. Weather & Acts Beyond Control

No refunds shall be issued due to:

Weather

Hurricanes

Flooding

Travel delays

Power outages

Government actions

Natural disasters

or other events beyond Host’s reasonable control.

Guests are encouraged to purchase travel insurance.

14. Illegal Activity

Illegal activity is strictly prohibited.

Including but not limited to:

Drug use

Weapons violations

Human trafficking

Prostitution

Fraud

Excessive disturbances

Violation may result in immediate eviction without refund and referral to law enforcement.

15. Right of Entry

Host may enter the property when reasonably necessary for:

Emergency situations

Repairs

Maintenance

Safety concerns

Inspection of suspected lease violations

Reasonable notice will be provided whenever practical.

16. Cancellation

Cancellation policies remain those selected during booking.

Host reserves the right to cancel reservations for violations of this Agreement or unforeseen circumstances beyond Host’s control.

17. Limitation of Liability

Guest understands that use of the property, pool, parking areas, sidewalks, common areas, and surrounding premises is entirely at Guest’s own risk.

Host shall not be liable for:

Personal injury

Death

Loss of property

Theft

Accidents

Illness

Acts of third parties

Weather-related events

Power outages

Internet interruptions

Guest expressly releases Host from liability except where prohibited by law.

18. Indemnification

Guest agrees to defend, indemnify, and hold harmless Studios 17 LLC, its owners, managers, employees, contractors, affiliates, and agents from any claims, damages, losses, attorney fees, or liabilities arising from Guest’s occupancy, negligence, misconduct, or violation of this Agreement.

19. Charge Authorization

Guest authorizes Studios 17 LLC to charge the payment method on file for:

• Damage repairs

• Missing items

• Smoking remediation

• Excess cleaning

• Unauthorized pets

• Unauthorized guests

• Late checkout

• Additional services requested

• Other amounts owed under this Agreement

Supporting documentation may be provided upon request.

20. Governing Law

This Agreement shall be governed by the laws of the State of Texas.

Venue for any dispute shall lie in Cameron County, Texas, unless otherwise required by law.

21. Electronic Acceptance

By completing a reservation, checking the acceptance box, or electronically signing this Agreement, Guest agrees that this electronic acceptance constitutes a legally binding signature under the Texas Uniform Electronic Transactions Act and the federal E-SIGN Act.

Studios 17 Guest Acknowledgment

By booking this property, I acknowledge that I have:

• Read this Rental Agreement in its entirety.

• Agree to comply with all House Rules.

• Accept financial responsibility for my party and any damages or violations.

• Understand that violations may result in immediate removal from the property without refund.
